Bonsai Nest operates this website, bonsainest.dk, including all related information, content, features, tools, products, and services (the "Services").

9|These Terms of Service, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, describe your rights and responsibilities when using our Services. Please read them carefully — they include important information about your legal rights.

13|SECTION 1 — ACCESS AND ACCOUNT

15|By agreeing to these Terms, you confirm that you are at least 18 years of age or the age of majority in your country of residence. You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account. You must provide accurate, complete, and current information when creating an account or placing an order.

17|SECTION 2 — PRODUCTS

19|We make every effort to display our products accurately. However, colours and appearance may vary depending on your screen and device settings. Product descriptions and prices are subject to change without notice. We reserve the right to discontinue any product at any time and to limit quantities on a case-by-case basis.

21|SECTION 3 — ORDERS

23|When you place an order, you are making an offer to purchase. Bonsai Nest reserves the right to accept or decline any order. Your order is not accepted until we confirm it. We must receive and process your payment before acceptance.

25|If we cannot accept or must cancel your order, we will contact you by email or phone. Please review your order carefully before submitting — we cannot guarantee cancellation after acceptance.

27|Your purchases must be for personal or household use, not for commercial resale.

29|SECTION 4 — PRICES AND PAYMENT

31|All prices are in Danish kroner (DKK) and include VAT (moms) where applicable. Prices are as displayed at the time of your order. We reserve the right to correct pricing errors, in which case we will notify you before processing.

33|We accept the payment methods displayed at checkout. You agree to provide accurate payment information and to pay all charges incurred, including shipping and applicable taxes.

35|SECTION 5 — SHIPPING AND DELIVERY

37|Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events outside our reasonable control.

39|Risk and responsibility: Under EU consumer law (Directive 2011/83/EU, Article 20), Bonsai Nest bears the risk of loss or damage to your order during transit. Risk passes to you only when you — or someone you designate who is not the carrier — take physical possession of the goods.

43|SECTION 6 — YOUR RIGHT OF WITHDRAWAL (FORTRYDELSESRET)

45|Under the Danish Consumer Contracts Act (Forbrugeraftaleloven), you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason. To exercise this right, notify us in writing at info@bonsainest.dk within 14 days of delivery.

47|Bonsai Nest also offers a voluntary 30-day guarantee on all bonsai trees — if your tree arrives damaged, dead, or fails to thrive within 30 days of delivery, we will replace it or refund you in full. This commercial guarantee is in addition to your 14-day statutory withdrawal right and 2-year legal guarantee.

51|SECTION 7 — LEGAL GUARANTEE (REKLAMATIONSRET)

53|All products purchased from Bonsai Nest are covered by the 2-year legal guarantee under the Danish Sale of Goods Act (Købeloven § 83). This guarantee covers defects that existed at the time of delivery — for example, a tree that was already diseased, pest-infested, or misidentified when shipped. It does not cover damage or death caused by improper care after delivery.

55|For defects discovered within the first 12 months after delivery, the defect is presumed to have existed at delivery unless we can prove otherwise. This is in addition to our 30-day commercial guarantee and is your statutory right.

57|SECTION 8 — INTELLECTUAL PROPERTY

59|All content on our Services — including text, images, graphics, logos, product descriptions, and design — is owned by Bonsai Nest, its affiliates, or licensors and is protected by Danish and international copyright and intellectual property laws. You may use the Services for personal, non-commercial purposes only. Reproduction, distribution, modification, or commercial use requires our prior written consent.

61|SECTION 9 — THIRD-PARTY TOOLS AND LINKS

63|We may provide access to third-party tools or links. We do not control or endorse these and are not liable for your use of them. Use third-party tools and websites at your own risk.

65|SECTION 10 — RELATIONSHIP WITH SHOPIFY

67|Bonsai Nest is powered by Shopify, which hosts our store and provides the e-commerce platform. All sales are between you and Bonsai Nest. Shopify is not a party to any transaction between you and Bonsai Nest.

71|Your privacy is important to us. How we collect, use, and protect your personal information is set out in our Privacy Policy. Shopify also processes certain personal information as described in their Privacy Policy.

73|SECTION 12 — FEEDBACK AND REVIEWS

75|If you submit reviews, feedback, or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them for any purpose, including improving our Services. You confirm that your submissions are your own, are accurate, and do not violate any third-party rights.

83|The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied. However, this disclaimer does not affect your statutory rights under Danish consumer law, including the legal guarantee (reklamationsret), the right of withdrawal (fortrydelsesret), and our 30-day commercial guarantee.

85|SECTION 15 — LIMITATION OF LIABILITY

87|To the fullest extent permitted by law, Bonsai Nest shall not be liable for indirect, incidental, or consequential damages. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Danish law.

91|You agree to indemnify Bonsai Nest against claims arising from your breach of these Terms, your violation of any law, or your misuse of the Services.

93|SECTION 17 — GOVERNING LAW AND JURISDICTION

95|These Terms are governed by Danish law. Any dispute arising from these Terms or your use of the Services shall be subject to the jurisdiction of the Danish courts.

97|If you are a consumer residing in another EU member state, you retain the protection of the mandatory consumer protection laws of your country of residence. Nothing in these Terms restricts your right to bring proceedings in the courts of your country of residence.
